If a portion of a relevant product is non-compliant, it must be identified and segregated from the rest prior to market placement or exportation.
The non-compliant portion cannot be marketed or exported.
If identification and separation cannot be done, such as when non-compliant products are mixed with compliant ones, the entire relevant product is deemed non-compliant.
– Example Scenario:
In cases where bulk commodities are mixed and associated with numerous land parcels, if even one parcel has been deforested post-2020, the entire relevant product becomes non-compliant.
– Exception Clause:
This does not override scenarios where 100% of relevant commodities or products meet the following criteria: traceability to land parcels, legal and deforestation-free status, and no mixing with non-compliant commodities.
