Operators downstream in the supply chain transform products listed in Annex I, already vetted through due diligence. Their obligations differ based on whether they qualify as Small and Medium-sized Enterprises (SMEs) or not.
For Non-SME Operators:
– Due Diligence Statement Submission: They can reference prior due diligence by providing relevant reference numbers in the Information System.
– Legal Responsibility: They must ensure diligence was conducted and retain accountability for Regulation compliance.
– Undiligenced Parts: Full due diligence and due diligence statement submission are mandatory for undiligenced parts.
For SME Operators:
– Similar Obligations: They share equal responsibility and liability for Regulation breaches.
– Exemptions for Diligenced Parts: No further diligence or due diligence statement submission required for already vetted parts.
– Undiligenced Parts: Full due diligence and due diligence statement submission are obligatory.
